  4. Good faith statement: Declare that you have a good faith belief that the use is unauthorized.

  5. Accuracy statement: Confirm under penalty of perjury that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.

  6. Signature: Include your physical or electronic signature.

B. Actions Taken by TrendyOnTee Upon Receiving a Valid Notice

Once we receive a properly formatted notice:

  • The allegedly infringing content will be removed or disabled.

  • The user responsible will be notified of the takedown.

  • Repeat violations may result in the termination of the user’s account and services.

C. Submitting a Counter-Notice

If you believe the content was removed or disabled by mistake or misidentification, you may submit a counter-notice including:

  1. Identification of the removed content: Include details of the material and where it appeared before removal.

  2. Good faith statement: Confirm under penalty of perjury that the removal was an error or misidentification.

  3. Your contact information: Full name, mailing address, phone number, and email.

  4. Consent to jurisdiction: State that you consent to the jurisdiction of the appropriate Federal Court (or local court if outside the USA) and accept service of process from the complaining party.

  5. Signature: Provide your physical or electronic signature.

Upon receiving a valid counter-notice, we may notify the original complainant. Unless they seek a court order within 10 business days, we may restore the removed content at our discretion.

Important Notice on Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly misrepresents material or activity as infringing may be held liable for damages, including legal fees.
